By creating an account, accessing, or using Merch Madness ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you are acting on behalf of a business, you represent that you have authority to bind that entity. If you do not agree, do not use the Platform.
You must be at least 18 years old and legally able to enter into contracts. By using the Platform you confirm that you meet these requirements and that all registration information you provide is accurate and current.
Merch Madness is an AI-powered merchandise creation platform that enables creators to design, produce, and sell custom print-on-demand products. We connect your approved designs with professional production and fulfillment through trusted third-party partners. You focus on the creative side — we handle the rest.
You must create an account to use creator features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
During onboarding you will be asked to connect at least one social media account. By connecting your social accounts, you authorize Merch Madness to post content to those platforms on your behalf when you launch drops or bundles. Posts are generated by AI and published automatically. Free-tier creators cannot disable auto-posting; Madness+ creators may toggle it off in Settings. You may disconnect social accounts at any time through Settings, which will stop future auto-posts to that platform.
You agree not to use the Platform for any unlawful, fraudulent, or abusive purpose. We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited activity.
You retain ownership of the designs you create on the Platform. By uploading or generating content, you grant us a non-exclusive, worldwide license to reproduce, display, store, and process your designs solely for the purpose of operating the Platform — including production, fulfillment, and mockup generation.
You represent and warrant that you own or have all necessary rights to any content you upload or create, and that your content does not infringe on any third-party intellectual property, trademark, or copyright. You are solely responsible for ensuring your designs comply with applicable laws.
You may not create or upload content that falls into any of the following categories. Violation may result in immediate content removal and account termination:
If you believe content on the Platform infringes your copyright, contact us at support@merchmadness.app with a description of the copyrighted work, the infringing material, and your contact information. We will investigate and take appropriate action.
Each approved design paired with a product forms a "drop." Free-tier drops are managed by our AI system, which may retire underperforming drops automatically. Madness+ creators have full manual control over their drop lifecycle.
Products are manufactured and shipped by our third-party production partners. While we work with trusted providers, we do not directly manufacture, warehouse, or ship products. Delivery timelines, print quality, and shipping are subject to our production partner's capabilities.
Colors displayed on screen may vary slightly from the final printed product due to differences in monitor settings, device displays, and printing processes. Minor color variations are inherent to print-on-demand production and are not considered defects unless the print is significantly different from the product listing.
Free-tier drops use auto-pricing based on our transparent cost-floor-plus-value-lift model. Madness+ creators can set custom prices. All prices are displayed to buyers before purchase.
Buyers pay the full product price at checkout. Your earnings (based on your profit-split tier or custom pricing) are routed to your connected Stripe Express account. If you have not completed Stripe onboarding, earnings accrue as a pending balance and are released once your account is set up.
Free-tier creators earn a profit share that scales with their rolling 90-day sales volume, ranging from 20% to 80%. Madness+ creators keep 100% of profit above the cost floor.
You are solely responsible for determining, reporting, and remitting any applicable taxes on your earnings. We do not provide tax advice.
When you purchase a product, you enter into a transaction facilitated by the Platform. Payment is processed by Stripe. Production and shipping are handled by our fulfillment partner.
Because products are custom-made to order, we do not accept returns for change of mind. If you receive a damaged, defective, or misprinted item, or if your package is lost in transit, you may file a claim within 30 days. Claims for received items require photo evidence. We will work with our production partner to resolve valid claims, which may include a replacement or refund at our discretion. Claims determined to be an error on our part are resolved at our expense.
If an incorrect shipping address is provided, you may be responsible for reshipping costs. Unclaimed packages returned to the production facility and not resolved within 30 days may be donated to charity.

Orders that have entered production cannot be cancelled. If an order has not yet been sent to production, you may request cancellation and we will do our best to accommodate.
Support is provided through our AI support system for both creators and buyers. For issues that cannot be resolved automatically, cases are escalated to our internal team. We do not guarantee response times but aim to address all inquiries promptly.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Merch Madness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.
Our total liability for any claim arising from these terms or your use of the Platform shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.
You agree to indemnify and hold harmless Merch Madness, its officers, employees, and partners from any claims, damages, losses, or expenses arising from your use of the Platform, your content, your violation of these terms, or your infringement of any third-party rights.
We may suspend or terminate your access at any time for violation of these terms, fraudulent activity, or any reason at our sole discretion. You may delete your account at any time through Settings. Upon termination, your right to use the Platform ceases immediately. Pending payouts will be processed according to Stripe's policies.
We may update these terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these terms or the Platform shall be resolved through binding arbitration on an individual basis, rather than in court or through class actions. You agree to waive any right to a jury trial or to participate in a class action.
Arbitration shall be administered in accordance with the rules of a recognized arbitration body. Each party shall bear its own costs, except as otherwise required by law.
This arbitration provision does not apply where prohibited by the laws of your country of residence. If you reside in the European Economic Area or the United Kingdom, you retain the right to bring claims in your local courts as provided by applicable consumer protection laws.
